The Trump EPA replaced President Obama’s legacy Clean Power Plan with the much weaker Affordable Clean Energy (ACE) rule. Yesterday Democrats tried to use a seldom-used legal maneuver that requires the signature of just 30 senators to review and overturn ACE.

It failed, but Democrats shouldn’t let this vote pass without expanding the narrative that any rules that weaken air pollution protections pose an immediate threat to the health of Americans.

Court Says EPA Must Do More To Curb Interstate Air Pollution

A three-judge panel that included a Trump appointee held on Tuesday that the EPA needs a better plan for addressing smog that travels across state lines from the midwest to the densely populated Northeast, where states are failing to meet federal air quality standards.

Why This Matters:  The EPA is failing to protect the public in the northeast from air pollution that is generated by coal power plants and manufacturing facilities in the midwest that travels with the winds and air currents into northeastern states who then are unable to meet their air quality standards.  This problem is EXACTLY why the federal government must be involved — and why the Clean Power Plan the Obama Administration put in place was so important.

Trump Proposes Replacement for Clean Power Plan That Favors Coal

The Trump Administration yesterday proposed to replace one of the signature domestic climate change achievements of the Obama Administration — the Clean Power Plan to cut emissions from coal plants — with the “Affordable Clean Energy” or ACE Rule — that essentially gives coal power plants more time and flexibility to cut toxic air emissions, which experts say could give those plants authority to increase their emissions in the short run.
